These Builder Rewards™ Program Terms of Service ("Terms") govern your access to and participation in the Builder Rewards™ Program (the "Program"), operated by Merino Club Capital Inc. ("Merino Club Capital," "MCC," "we," "us," or "our").
By creating an account, selecting a plan, accessing the Dashboard, or otherwise using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms or disclosures made available to you from time to time (collectively, the "Agreement").
SECTION I — DEFINITIONS
Unless otherwise stated:
- "Builder Rewards™" or "Program" means MCC's performance-based accountability program designed to encourage disciplined credit-related habits.
- "Member" means an individual who enrolls in the Program.
- "Plan" means a participation option displayed on the Compare Plans page, including the $30 Subscription Plan and Accountability Anchor plans.
- "Accountability Anchor" means a refundable performance-based deposit required for certain plans.
- "Cashback Rewards" means promotional credits recorded within the Program, subject to eligibility rules.
- "Credit OS™" means MCC's internal educational framework.
- "Platform" means MCC's website, calculator tools, dashboards, login areas, and related interfaces.
SECTION II — PLATFORM & SITE CONTEXT
Merino Club Capital makes the Program available through various site areas, including but not limited to:
- About
- Compare Plans
- Learn
- Calculator
- Dashboard
- Login / Get Started
Use of any part of the Platform constitutes participation in the Program and acceptance of these Terms.
SECTION III — PROGRAM NATURE & KEY DISCLOSURES
Not a Financial Product
Builder Rewards™ is not:
- a loan or line of credit
- a bank account or deposit
- an investment or security
- an interest-bearing or income-generating product
No Expectation of Profit
The Program is designed to promote disciplined financial behavior. Members should not expect profit, yield, interest, or capital appreciation. For clarity, the availability of Cashback Rewards does not change the non-investment, non-deposit, and non-lending nature of the Program.
No CDIC Insurance
Any funds provided to MCC, including Accountability Anchors, are not insured by the Canada Deposit Insurance Corporation (CDIC).
SECTION IV — ELIGIBILITY & ENROLLMENT
To enroll, you must:
- Be a resident of Canada;
- Have reached the age of majority in your province or territory;
- Provide accurate and complete registration information.
MCC may accept, decline, suspend, or terminate enrollment at its sole discretion.
SECTION V — PLANS & PARTICIPATION OPTIONS
The Program may offer multiple Plans, as described on the Compare Plans page, which may include:
- A monthly subscription plan with a non-refundable service fee; and
- One or more Accountability Anchor plans requiring a refundable performance deposit.
Plan features, fees, reward caps, trial periods, and graduation conditions are disclosed at signup and may change from time to time. Cashback Rewards are offered as an engagement incentive and not as compensation for funds provided to MCC.
SECTION VI — ACCOUNTABILITY ANCHORS
Purpose
Accountability Anchors function as performance-based participation deposits intended to reinforce consistency and engagement.
Nature of Funds
- Anchors are not deposits, loans, or investments.
- No interest is paid.
- MCC may commingle Anchor funds with general operating funds for Program administration.
Refunds & Contractual Commitment
Subject to compliance with these Terms, refundable Anchor amounts represent a contractual obligation of MCC and are returned upon exit or graduation, net of any applicable early exit fees.
Refunds are issued by electronic funds transfer (EFT) to the Member's designated account.
SECTION VII — CASHBACK & PROMOTIONAL REWARDS
Nature of Cashback
Cashback Rewards:
- are real cash incentives, payable to the Member in Canadian dollars;
- are earned through participation and completion of Program requirements;
- are not interest, yield, investment income, or a return on capital.
No Financial Product Characterization
Cashback Rewards do not represent:
- interest on funds,
- profit sharing,
- investment returns,
- or compensation tied to the use, holding, or performance of Accountability Anchors.
Earning & Limits
Cashback amounts, eligibility criteria, monthly caps, and issuance timing vary by Plan and are disclosed on the Platform (including the Compare Plans page). MCC may modify these parameters from time to time.
Payment & Redemption
Cashback may be issued to the Member through methods determined by MCC, including account credits or direct payment, as disclosed on the Platform. Eligibility, monthly caps, and redemption mechanics are determined by MCC and may vary by Plan.
Promotional Nature
Cashback Rewards are:
- promotional in nature
- non-transferable
No Property Right
Members have no vested or property interest in Rewards until applied or redeemed within the Program.
Taxes
Members are solely responsible for determining and reporting any tax obligations related to Cashback Rewards.
SECTION VIII — CREDIT OS™ & EDUCATIONAL CONTENT
Credit OS™ and related educational modules provide informational tools and structured habit-building guidance only.
MCC:
- Does not provide credit repair services;
- Does not guarantee improvement to credit scores;
- Does not provide financial, legal, or investment advice.
SECTION IX — EXIT, TERMINATION & PROGRAM CHANGES
Member Exit
Members may exit the Program at any time. Early exit fees may apply depending on the selected Plan.
Graduation Conditions
Certain Plans may provide reduced or waived exit fees after completion of disclosed participation milestones ("graduation").
Program Changes or Closure
MCC may modify, suspend, or terminate the Program at any time. If the Program is discontinued without Member breach, any remaining refundable Anchor balance will be returned in full.
SECTION X — PAYMENTS & AUTHORIZATIONS
By enrolling, you authorize MCC to:
- Charge applicable subscription fees;
- Apply early exit fees where applicable;
- Retain payment credentials for recurring billing or settlement purposes.
SECTION XI — LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- MCC's liability is limited to the refund of any net refundable Accountability Anchor;
- MCC is not liable for indirect, incidental, or consequential damages;
- The Program is provided "as is" and "as available."
SECTION XII — GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario, and the federal laws of Canada applicable therein, unless otherwise required by law.
SECTION XIII — GENERAL
- Amendments: MCC may update these Terms from time to time.
- Entire Agreement: These Terms constitute the entire agreement regarding the Program.
- Severability: Unenforceable provisions do not affect remaining terms.
- Assignment: Members may not assign rights or obligations.
